With this Notice it is intended to carry out an exploratory market survey in order to find out if, differently from the information in possession of this contracting authority, other economic operators, other than the manufacturer, can provide for the contractual duration of 24 months theglobal maintenance and technical assistance services for scientific laboratory equipment of the following brands: Agilent Technologies; Thermo Fisher Diagnostics; Bruker; Biomerieux; Holes; Foss; Lab Service Analytica; Life Technologies/Applied Biosystems/Thermo Fisher Scientific; Millipore/Merck; Perkin Elmer; Gilson; Siemes Healthcare; TNE; Waters; ABSciex; Pall Italia; Biomedis; Dasit; 3P Bioservice.
Therefore, this Notice is aimed at confirming or not the existence of the conditions of non-fungibility/exclusivity which allow, pursuant to art. 76 paragraph 2 letter. b) points 2 and 3 of the Legislative Decreegs n. 36/2023, the use of the negotiated procedure without publication of a notice for the assignment in question. It is therefore not permitted at this stage to submit offers, quotations or economic evaluations.
If, following this market survey, it is confirmed that the operators andeconomical manufacturers of the instruments are the only ones capable of guaranteeing the required maintenance services, this contracting authority will proceed with the completion of distinct negotiated procedures without a tender pursuant to art. 76 c. 2 lett. b) of Legislative Decree no. 36/2023, negotiating the contract itself only...
