  Open procedure pursuant to art. 53, paragraph 2, letter b of Legislative Decree 163/06 for the award of the contract concerning the drafting of the projectand executive and execution of the construction works of the underground multi-storey car park in via Vannucchi and relative parking level under the PII, according to the provisions of the tender documentation and the final project approved by the Contracting Station.
  Main Site: Municipality of San Donato Milanese (MI), via Vannucchi.
  Drafting of the executive planning and execution of the limplementation of the underground multi-storey car park in via Vannucchi and relative parking space under the PII, as provided for in the tender documentation and in the final project approved by the Contracting Authority. All individuals, single or associates, referred to in art. 34, paragraph 1, of Legislative Decree 163/2006 and referred to in art. 90, paragraph 1lett. d), e), f), f-bis), g), h) of Legislative Decree 163/2006, within the limits set by art. 36, paragraph 5, and 37, paragraph 7, of Legislative Decree 163/2006, as well as economic operators based in other EU Member States, provided that the causes of exclusion indicated below do not exist against them. Registration in the Chamber of Commerce, Industry and Crafts and Agriculture Register is requiredin the register of craft enterprises, or in one of the professional or commercial registers of the state of residence, if it is a U.E. state, in accordance with the provisions of art. 39 of Legislative Decree 163/2006. It is also required to register with the competent professional orders. The declarations and / or documentation are required in the manner specified in the Tender Regulationstherein indicated.
  Participation in the tender of competitors is not permitted:
  a) for which all the causes of exclusion as per art. 38 of Legislative Decree 163/2006;
  b) that are affected by the individual surfacing plans pursuant to art. 1 bis, paragraph 14, of Law October 18, 2001, no. 383;
  c) for which measures have been taken pursuant to art. 14 of Legislative Decree 9 April 2008, n. 81. d
  ) for which there is any other situation that determines the exclusion from the tender pursuant to Legislative Decree n. 163/2006, of the Presidential Decree n.207 / 2010 and other provisions of laws in force;
  e) for which there are simultaneous participation in the tender in more than one ordinary grouping or consortium or in an individual form and in an ordinary grouping or consortium or in more than one stab consortiumile or as a competitor in any form and as a consortium member indicated, pursuant to art. 36, paragraph 5 of Legislative Decree n. 163/2006 or as an independent competitor and as a consortium member indicated, pursuant to Article 37, paragraph 7, last sentence, of Legislative Decree n. 163/2006, by one of the consortia referred to in art. 34, paragraph 1, lett. b) of the Legislative Decree n. 163/2006 participant in the tender.
  For economic operatorsi established in other member states of the EU. compliance with the provisions of the limbs applies. 38 paragraph 5 and 39 of Legislative Decree 163/06.
  The absence of the preclusive conditions listed above is proven, under penalty of exclusion, with the procedures, forms and contents provided for in the Tender Regulations.
  Not allowed the participation in the tender of designers indicated or associated:
  a) for which there are cause of exclusion referred to in art. 38 of Legislative Decree no. 163/2006;
  b) for which there are the causes of exclusion pursuant to art. 253 of the D.P.R. 207/2010;
  c) for which the reasons for exclusion exist as per art. 90, paragraph 8 of Legislative Decree n.163 / 2006;
  d) inhibited by law or by disciplinary measure in the exercise of professional activity;
  e) that do not meet the requirements ofall'art. 254 and 255 of the D.P.R. 207/2010 and subsequent amendments, respectively in the case of engineering companies or professional companies;
  f) for which the requirements of art. 90, paragraph 7, of Legislative Decree n. 163/2006;
  g) the existence of individual emergence plans pursuant to art. 1 bis, paragraph 14 of law no. 383/2001 ex. m.;
  h) for which measures have been taken or are pending pprovisions pursuant to art. 14 of Legislative Decree 9 April 2008, n. 81;
  i) for which there is any other situation that determines the exclusion from the tender pursuant to Legislative Decree n.163 / 2006, of the D.R.R. n.207 / 2010 and other provisions of current laws.
  The absence of the preclusive conditions listed above is proven, under penalty of exclusion, with the procedures, forms and contents provided for in the Disciplinary ofTender.
  See point III.1.3) of the Tender Notice.
  The overall term of the tender is to be intended in 45 consecutive natural days (not subject to discount), starting from the signing of the contract, as a deadline for completion of the final design ; 320 natural and consecutive days (subject to discount), starting from the date of delivery of the works, as a deadline for completion ofjobs; all as specified in the Contract Scheme and in the Special Contract Specifications. The award criterion is that of the most economically advantageous tender pursuant to Articles. 83 of Legislative Decree 163/06 and 120 of Presidential Decree 207/10, based on the aggregation-compensator method as per annex G of the aforementioned Presidential Decree and according to the valuation coefficients and methods indicated in art. 17 of the Regulations. The Pmaximum number assigned by a special commission, appointed pursuant to art. 84 Legislative Decree 163/06, after the expiry of the deadline set for the submission of offers, and equal to 100 points and is divided as follows: 65 items quality elements and 35 items quantitative elements.
  Ex art . 88, co. 7 of Legislative Decree 163/06, the SA reserves the right to proceed simultaneously with the verification of the anomaly of the best offersyou, no later than the fifth, without prejudice to the provisions of the co. from 1 to 5 of the art. 88 Legislative Decree 163/2006.
  Subcontracting is permitted within the limits of the law and in compliance with the provisions set forth in Articles 37, co.11, 91, co. 3, and 118 D.Lgs. 163 / 06.
  The competitor is obliged to indicate, at the time of submitting the offer, the elected domicile for communications and the PEC address for sending the stesse, authorizing the use of this means, in accordance with the provisions of the Regulations.
  Any questions or requests for clarification regarding the tender documentation may be made exclusively by PEC to be sent to the SA by 06/17/9, 12.00. The answers to the questions promptly received will be published on the SA website at: www.deacapitalre.com - Tenders.
  The contract will be awarded even in the presence of only one valid offer, as long as it is deemed appropriate, convenient and appropriate in relation to the object of the contract.
  In the event of an equal overall score, the position of the competitor who has achieved the best technical score; in the case of a further equal, the public draw will proceed.
  E'mandatory, pursuant to art. 106, co. 2 Presidential Decree 207/10, the viewing of the places affected by the works set for 3.6.2019, 11.00 and 14.6.2019, 11.00 am according to the modalities described in the Disciplinary.
  The Notice does not bind the SA in any way of the tender, and its subsequent awarding.
  The SA reserves the right to suspend / revoke / cancel the tender or modify itwaives at any time and at its sole discretion, without this entailing the possibility of any claim / claim / expectation / compensation / indemnity or request of any kind.
  The SA reserves the right, at its sole discretion, to ask the competitors for clarifications regarding the documentation submitted.
  The SA reserves the right to apply the art. 140 D.Lgs. 163 / 06.
  The SA reserves itselfto initiate the execution of the contract urgently.
  The Contract Scheme does not contain the arbitration clause; all disputes arising from the contract are referred to the competent Judicial Authority.
  The data collected will be processed pursuant to Legislative Decree 196/03, exclusively in the context of this procedure, as well as for any subsequent stipulation and management of the contract.
  I'mthe contractor's costs and all the charges connected with his stipulation are to be paid by the successful tenderer.
